1. Introduction

These Terms of Service ("Terms") govern your use of the Spoken Treasure website (the "Website") and the services provided by Spoken Treasure ("we," "us," or "our"). Spoken Treasure provides audio guest books for events, processes these recordings, and delivers them to clients in physical and/or digital form.

By accessing our Website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Website or services.

2. Definitions

- "Service" refers to the provision of audio guest books for events, processing of recordings, and delivery of recordings in physical and/or digital form.

- "Client" or "you" refers to any individual or entity that books or uses our services.

- "Content" refers to audio recordings, customer data, and any other information collected through our service.

- "Booking" refers to the reservation of our services for a specific date, time, and location.

3. Service Description

Spoken Treasure provides audio guest books for weddings and events. We pre-install a client provided recording onto the audio guest book and ship the guest book to your specified address, process audio guest book recordings, and provide you with the final product in physical and/or digital format according to your order.

4. User Eligibility

To use our services, you must be at least 18 years of age and capable of forming a legally binding contract. By booking our services, you confirm that you meet these requirements.

5. Booking and Payment Terms

5.1 Online Bookings

Bookings and payments made through our website are processed via our domain host, Squarespace. By making an online booking, you agree to provide accurate and complete information and to comply with the payment terms specified on our Website.

5.2 In-Person Bookings

For bookings made at wedding fairs and other events, we accept deposits to secure your booking. Following receipt of your deposit, we will send an invoice for the remaining balance, which must be paid no later than 60 days before the product shipping date.

5.3 Payment Obligations

All payments, whether deposits or final balances, must be made by the due dates specified. Failure to make timely payments may result in cancellation of your booking without refund of any deposits paid.

6. Cancellation, Rescheduling, and Refund Policy

All deposits and purchases are non-refundable. Spoken Treasure is under no obligation to provide a refund or reschedule dates. Any refund or date change is at our sole discretion and subject to our ability to accommodate such changes.

7. Delivery and Return of Recording Devices

7.1 Delivery Areas

We guarantee delivery only to addresses within the United Kingdom. Delivery to addresses outside the UK is subject to prior agreement and may incur additional charges.

7.2 Delivery Methods

Digital recordings will be provided via secure download link. Physical recordings and devices will be delivered via third-party courier services to the address provided at booking.

7.3 Delivery Timing

We will arrange for shipping of physical products to ensure delivery at least 2 days before your specified event date. While we make every effort to ensure timely delivery, we cannot be held responsible for delays caused by third-party courier services beyond our reasonable control.

7.4 Device Return Requirement

You must return the recording device using the provided prepaid return method within 5 working days of the specified date of the event. Failure to return the device within this timeframe may result in additional charges. The client remains responsible for the device until it is received by Spoken Treasure.

8. Geographic Limitations

Our services are primarily designed for use in the United Kingdom. We make no representations that our services are appropriate or available for use in other locations. If you access or use our services from other jurisdictions, you do so at your own risk.

9. Quality and Performance

Every reasonable effort will be made to complete your order and ensure that our audio guest books are in working order at your event. In the event that the order is not completed or there is an issue with our services, our liability shall be limited to the price of the order.

10. Equipment Damage

We reserve the right to seek compensation for damage to our audio guest books caused by you or your guests and for our subsequent inability to complete other orders due to said damages. You agree to take reasonable care to prevent damage to our equipment during your event.

11. Limitation of Liability

Except as expressly stated in these Terms, Spoken Treasure shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use our services. Our maximum liability for any claim arising under these Terms shall not exceed the amount paid by you for the services.

12. Data Protection and Privacy

We collect and process personal data in accordance with our Privacy Policy and applicable UK data protection laws. We will only collect, use, and share your information in ways that comply with these laws. By using our services, you consent to such processing and confirm that all data you provide is accurate.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes to these Terms via email within 5 working days of such changes. Your continued use of our services after such notification indicates your acceptance of the modified Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Scotland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the Scottish courts.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Consumer Rights

Nothing in these Terms affects your statutory rights as a consumer under UK law.

17. Force Majeure

We shall not be liable for any failure to perform our obligations where such failure is a result of acts of nature, government actions, war, civil unrest, or other circumstances beyond our reasonable control.
